The driver is responsible for securing the load (load locks).. if the load shifts, damages will be deducted from the freight or (if severe enough that they exceed the freight rate) filed under the carrier's cargo insurance.
Shortages are also deducted so observing the loading process is important. If a driver signs bills of lading that show 1000 cases of x but ends up a pallet short during delivery, the delivered price of the missing product is often deducted.
The point: If a driver doesn't like working for free or losing their job, they'll pay close attention to the loading process and security of every load.

The driver is always responsible for the trailer and its contents. This includes the security of the load and the weight of the load. There are a lot of drivers out there who could care less about a load and they are the ones who have a load shift and lay a trailer over on it's side. If you want a real treat, try hauling a load of swinging meat in a reefer.

I have to agree, it's the driver. I'm a receiving dock porter at a hospital; we receive truckloads of supplies all the time. The driver is responsible for securing his/her load, for securing the vehicle (brakes and wheelchocks), and primarily responsible for unloading the truck (we will assist) when it's at our dock. Once the load is off the truck and on our dock it's our responsibility.
